01.Acceptance of these terms
These Terms of Service (the “Terms”) govern your use of clive, the live-clipping product operated by the team behind Skeet. By creating an account or otherwise using clive, you agree to these Terms. If you do not agree, do not use the service.
02.Eligibility
You must be at least 13 years old (16 in the European Economic Area) and able to form a binding contract under the laws of your jurisdiction. If you use clive on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
03.Your account
You are responsible for everything that happens under your account, including the activity of anyone you share access with. Keep your password and stream key confidential, and notify us immediately if you believe either has been compromised. We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.
One person or organisation may not maintain multiple accounts to evade limits, bans, or trial restrictions.
04.What clive does
clive watches a live stream you push to us, identifies clip-worthy moments using your written directives, produces short-form edits, and posts those clips to the third-party platforms you have connected.
The service depends on machine-learning models that are not perfect. We do not guarantee that every clip-worthy moment will be captured, that every produced clip will be a good clip, or that captions will be accurate. Review clips before relying on them.
05.Your content
You retain ownership of the streams you broadcast and the clips produced from them (collectively, “Your Content”). You grant clive a worldwide, royalty-free, non-exclusive licence to host, process, transcode, analyse, and transmit Your Content strictly for the purpose of operating clive and posting clips to the platforms you have connected.
You are responsible for ensuring you have the rights to broadcast the content you push to clive, including any music, game footage, guest appearances, or third-party material that appears in your stream. See the Acceptable Use Policy for content restrictions and our DMCA process.
06.Third-party platforms
When you connect YouTube, TikTok, Instagram, Twitch, Kick, or X to clive, your use of those platforms is governed by their own terms and policies. You are responsible for complying with them and for any consequences (including account suspensions on those platforms) that result from clips clive posts on your behalf. We are not affiliated with these platforms.
07.Fees, subscriptions, and refunds
Some clive features are available only on paid plans. Current pricing is shown on clive.skeet.now/#pricing. Subscriptions renew automatically until you cancel. You may cancel from your account dashboard at any time; cancellation takes effect at the end of your current billing period.
Except where required by law, fees are non-refundable. We may change our pricing, the features included in a plan, and the credit allotments a plan grants, on at least 30 days’ notice. Any such change takes effect at your next renewal and does not affect your current billing period. If you do not agree to a change, you may cancel before it takes effect.
08.Credits
Paid plans and certain purchases grant credits, which are consumed by the actions clive takes on your behalf, such as watching your live stream and editing clips. One credit corresponds to a unit of usage described on our pricing page and how credits work page. We may adjust the number of credits a plan grants, and the rate at which features consume credits, on at least 30 days’ notice, effective at your next renewal.
Credits included with a subscription refresh to your plan’s allotment at the start of each billing period and do not stack from one period to the next. If your balance is exhausted, you may upgrade your plan or enable pay-as-you-go billing, in which case continued usage is charged at the rates shown on our pricing page. Credits have no cash value, are not transferable, and are not redeemable for money except where required by law. Except where required by law, purchased credits are non-refundable.
Free or promotional credits are provided at our discretion, may be limited in amount or duration, and may be modified or discontinued for future grants at any time. When your credit balance reaches zero, credit-metered features stop until you upgrade, enable pay-as-you-go billing, or your next subscription period begins.
09.Termination
You may close your account at any time from your dashboard. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, if your use poses a security or legal risk to clive or its users, or if we cease offering the service. On termination, Sections covering Your Content licences (for clips you have posted publicly through third-party platforms), Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution survive.
10.Disclaimers
clive is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, that defects will be corrected, or that AI-generated edits will be of any particular quality or accuracy.
11.Limitation of liability
To the maximum extent permitted by law, in no event will clive, its affiliates, or its personnel be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of clive, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) US$100.
12.Indemnification
You agree to defend, indemnify, and hold harmless clive, its affiliates, and its personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use of the service, (c) your violation of these Terms or the Acceptable Use Policy, or (d) your violation of any third-party right, including the terms of any platform you have connected to clive.
13.Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that is not subject to arbitration. Where permitted by law, any dispute will be resolved by binding individual arbitration; you and we each waive the right to a jury trial and the right to participate in a class action.
14.Changes to these Terms
We may update these Terms from time to time. For material changes we will give you at least 14 days’ notice by email or via the product before the new Terms take effect. Continuing to use clive after the effective date means you accept the updated Terms.
